This Refund & Cancellation Policy explains how cancellations, refunds, project termination, and payments for work already performed are handled by Dexxter GWM. Specific project agreements may establish additional or different terms, which will govern the applicable engagement.
1. Scope
This Policy applies to professional technology services provided by Dexxter GWM, including software development, web applications, APIs, integrations, automation, backend systems, frontend interfaces, maintenance, testing, and related technical services.
This Policy is intended to establish the general rules for cancellations and refunds. A proposal, statement of work, or service agreement may establish project-specific payment, milestone, cancellation, termination, or refund conditions.
Where a project-specific agreement contains terms that differ from this Policy, the applicable agreement will govern that engagement.
2. No Automatic Refund for Completed Work
Professional software development is a service performed over time. Payments made for work that has already been performed are generally not refundable solely because the client later decides not to continue the project.
Work performed may include discovery, planning, architecture, design, development, testing, deployment, documentation, meetings, technical research, project management, infrastructure configuration, and other activities required to deliver the agreed scope.
A refund does not automatically apply merely because a project is incomplete when the client requests cancellation.
3. Client Cancellation Before Work Begins
If the client cancels an engagement before Dexxter GWM has materially begun work, amounts paid may be eligible for a refund, subject to any non-refundable fees, third-party costs, or specific cancellation terms agreed in the applicable proposal or service agreement.
If work has already begun, the refund will be determined according to the work performed and costs incurred before the cancellation became effective.
4. Client Cancellation During a Project
A client may request cancellation of an ongoing project by providing written notice through the agreed communication channel.
Upon receiving a cancellation request, Dexxter GWM will determine the amount earned for work performed up to the effective termination date and any eligible amount remaining from payments already received.
The client remains responsible for amounts corresponding to work completed, work in progress that has been performed and is reasonably attributable to the project, approved expenses, non-refundable third-party costs, and other amounts expressly payable under the applicable agreement.
Where an amount remains refundable after these deductions, Dexxter GWM will return the eligible balance to the client.
If the amount already paid is less than the value of work and approved costs incurred up to termination, the client remains responsible for the outstanding balance where permitted by the applicable agreement and law.
5. Milestones and Deposits
Project deposits, retainers, milestone payments, or other advance payments may be used to reserve development capacity, begin project preparation, or fund work scheduled for a specific stage of the engagement.
Unless otherwise agreed in writing, such payments are not automatically refundable once the corresponding work or project stage has begun.
The applicable proposal or service agreement may define specific milestone payment and cancellation conditions for the project.
6. Refunds for Service Issues
If Dexxter GWM materially fails to provide an agreed service, the client should first provide an opportunity to identify and correct the issue where reasonably possible.
Depending on the circumstances and the applicable agreement, the resolution may include correction of the affected work, completion of outstanding obligations, replacement of defective deliverables, a service credit, or a proportional refund.
A refund will not ordinarily be the first remedy where the issue can reasonably be corrected within the agreed scope.
7. Changes in Requirements
Changes to requirements, scope, integrations, technical constraints, deadlines, or project direction requested by the client do not by themselves create a right to a refund.
Material changes may require a revised scope, timeline, budget, or agreement before additional work is performed.
If a client chooses to terminate the project because the agreed requirements have changed, cancellation will generally be handled under the project termination provisions rather than treated as a refund for undelivered work.
8. Third-Party Costs
Amounts paid to third parties on behalf of a project may be non-refundable when the third party's own terms do not permit a refund.
Examples may include hosting, domains, software licenses, subscriptions, infrastructure, external APIs, payment processing fees, or other third-party services.
Where such costs are separately identified or approved by the client, they may be deducted from any amount otherwise eligible for refund.
9. Non-Refundable Circumstances
Except where required by applicable law or otherwise agreed in writing, refunds are generally not available for work already performed, completed milestones, approved expenses, non-refundable third-party costs, or services that have been delivered and accepted.
Refunds are also not intended to apply solely because the client changes business priorities, changes their mind about the project, decides not to use the delivered work, or chooses another provider after work has been performed.
Nothing in this section limits any mandatory refund, cancellation, consumer, or other legal right that cannot lawfully be excluded.
10. Prohibited Refund Claims
A client must not intentionally misrepresent the condition, status, or delivery of a project to obtain a refund.
Refund requests must relate to an actual cancellation, service issue, payment error, or other legitimate basis recognized by this Policy, the applicable agreement, or applicable law.
Fraudulent, abusive, or intentionally misleading refund claims may result in suspension of the engagement and the exercise of any rights available under the applicable agreement and law.
11. Refund Processing
Approved refunds will generally be returned using the original payment method where reasonably possible.
The time required for a refund to appear may depend on the payment provider, financial institution, or other intermediary involved in the transaction.
Dexxter GWM is not responsible for delays caused solely by a payment provider or financial institution after the refund has been initiated.
12. Cancellation by Dexxter GWM
Dexxter GWM may terminate an engagement where permitted by the applicable service agreement, including in circumstances involving non-payment, material breach, abusive conduct, unlawful requests, prolonged client inactivity, or circumstances that make continued performance commercially or technically unreasonable.
Where Dexxter GWM terminates an engagement without client fault, any refund or payment adjustment will be handled according to the applicable agreement and the amount of work performed.
Where termination results from the client's breach or other circumstances attributable to the client, amounts already earned or otherwise payable under the applicable agreement remain due.
13. Legal Rights
Nothing in this Policy is intended to exclude, restrict, or waive any right or remedy that cannot legally be excluded or waived under applicable law.
Where mandatory consumer protection, cancellation, refund, or other legal requirements apply to an engagement, those requirements will prevail over any conflicting provision of this Policy.
For international engagements, the applicable agreement may establish additional provisions regarding jurisdiction, governing law, cancellation, and dispute resolution, subject to mandatory legal protections.
14. Relationship With the Terms of Service
This Policy forms part of the general terms applicable to Dexxter GWM's services and should be read together with the Terms of Service and Privacy Policy.
Project-specific payment, cancellation, termination, and refund provisions may be established in the applicable proposal, statement of work, or service agreement.
15. Changes to This Policy
Dexxter GWM may update this Policy when necessary to reflect changes to its services, payment practices, contractual arrangements, or applicable legal requirements.
